EPAM Successful for Petersburg Tractor Plant in Claim of Unfair Competition Against Spetsstroymash

Egorov, Puginsky, Afanasyev and Partners has successfully defended the interests of the Petersburg Tractor Plant in an unfair competition dispute.

EPAM describes JSC Petersburg Tractor Plant (JSC PTZ) as "one of the oldest and one of the largest Russian tractor manufacturers," and reports that "tractors and other road equipment manufactured by PTZ, manufactured under the Kirovets brand since the 1960s, have a distinctive appearance and special identification numbers of models that have become widely recognized among consumers for more than 50 years of production."

EPAM's lawyers demonstrated that equipment produced by a competitor, Spetsstroymash LLC, "imitated the appearance of the Kirovets equipment, including special model identification numbers, which could entail the mixing of goods from competitors in the tractor products market [and] also violates the exclusive rights to the principal’s industrial design protected by a patent."

The EPAM team working under the guidance of Advisor Denis Gavrilov included lawyers Ksenia Firsova, Darya Sergeeva, and Maria Kuznetsova.
