On 2 May 2025, the Law of Ukraine "On Amendments to the Labour Code of Ukraine Regarding the Improvement of Legal Regulation of Certain Issues of Home-based and Remote Work" (the "Law") entered into force.
The Law amends Articles 60¹, 60², and 121 of the Labour Code of Ukraine (the " Labour Code") to regulate the procedure for business trips for home-based and remote employees. It also establishes the right of employees to home-based or remote work for the period of their child's distance education.
The Law introduces the following key updates:
- In the case of home-based or remote work, employer and employee must agree in advance on terms and procedure for possible business trips in the employment agreement.
- For remote employees, i.e., employees without a fixed workplace, the employer and the employee shall agree on the points of departure and return for a business trip, including electronically, and indicate this information in the business trip order. Prior to the commencement of the business trip, such an employee must notify the employer of their current location.
- Travel by a remote employee to the employer’s location may be classified as a business trip.
- The Labour Code is supplemented with a provision stating that employee may perform work at home or remotely if their child under the age of 14 is enrolled in distance learning at a general secondary education institution. However, this option is available only with the employer’s consent.
